Student Loan Forgiveness Update (June 2023)

The official decision hasn’t been rendered, but this recent update provides students and graduates with a roadmap.

Where do we “stand”?

  • The central legal question in all of this is whether the Biden administration’s legal authority to enact the student loan forgiveness plan – is valid.
  • The other major question is whether the parties that initiated the legal challenges (Biden Administration, State Loan Servicers, ect) have “standing” to sue. Standing, ultimately means : Can the law regarding Biden’s legal authority to forgive loans, be challenged?
  • Without “standing”, a party cannot sue and is not entitled to the relief they are trying to obtain.

So, the question now is, does Biden’s administration have proof to show the harm that would happen if they can not change the law and grant Biden’s administration power to forgive student loans?

The answer, now lies in the hands of the Supreme Court, who will decide if Biden’s administration has “standing” , or does not.

The final decision may arrive this week, but I personally expect there to be no “standing”, which means- that if you haven’t already, PREPARE TO RESUME YOUR STUDENT LOAN PAYMENTS.
